1. Overview

These Terms govern your access to and use of the Orbit website (the "Site") and any freelance software engineering services offered (the "Services"). By using the Site you agree to these Terms. If you engage Services, a separate written proposal or agreement may supplement or override specific sections.

2. Informational Content Only

The Site provides portfolio, case studies, and informational articles. Nothing here constitutes legal, financial, or investment advice. Technical examples are illustrative and may omit hardening steps.

3. Client Engagements

Project scope, deliverables, timelines, and payment terms are defined in a written proposal or statement of work ("SOW"). Work begins only after mutual written acceptance. If a conflict exists between the SOW and these Terms, the SOW controls for that project.

4. Intellectual Property

Unless otherwise stated in a signed SOW, custom code delivered under paid engagements becomes the client's property upon full payment. Pre‑existing tools, libraries, internal templates, or generic utility snippets may be reused across projects; ownership of such pre‑existing materials remains with Orbit while a license to use within delivered code is granted.

5. Acceptable Use

You agree not to misuse the Site, attempt unauthorized access, deploy automated scraping beyond standard indexing, or introduce malware. Reverse engineering of proprietary build artifacts showcased in visual demos is prohibited.

6. Confidentiality

Confidential materials shared in the course of a project (e.g., internal architecture diagrams, credentials, proprietary data) are kept confidential and used solely for performing agreed Services. Do not send production credentials through the public contact form—secure channels will be provided upon engagement.

7. Payment & Invoicing

Invoices are due per the SOW (e.g., milestone or monthly). Late payments may pause delivery. Any third‑party service costs (cloud, licenses, API usage) are the client's responsibility unless explicitly included in the SOW.

8. Warranty & Disclaimer

Delivered code is provided "as is" unless a warranty period is specified in the SOW. Reasonable bug fixes tied directly to agreed functionality are addressed promptly within any stated stabilization window. No guarantee is made regarding future platform changes, third‑party API shifts, or security threats emerging after delivery.

9. Limitation of Liability

To the maximum extent permitted by law, Orbit shall not be liable for indirect, incidental, special, consequential, or punitive damages, nor lost profits, revenue, data, or business interruption arising from use of the Site or Services. Aggregate liability for any claim is limited to fees paid for the specific project giving rise to the claim.

10. Third‑Party Links & Tools

External links or technology references (libraries, APIs, deployment platforms) are provided for convenience; no endorsement or guarantee is made. Use such third‑party services under their own terms and licensing.

11. Termination

Either party may terminate an engagement per its SOW. Sections on IP ownership, confidentiality, limitation of liability, and payment survive termination. Portfolio references may include high‑level, non‑confidential descriptions of delivered work unless explicitly restricted in writing.

12. Changes to These Terms

Terms may be updated periodically; material changes are dated via the "Last Updated" line. Continued Site use after changes constitutes acceptance. For active SOWs, changes apply prospectively only unless otherwise agreed.
